of the ruling of the First Senate of the German Supreme Court of 12th December 2000

1 BvR 1762/95 -

1 BvR 1787/95 -

1. The freedom of press of a publisher of a magazine can be infringed, when the publisher is ordered to cease and desist from publishing such advertisements the creation of which is permitted due to the advertising party’s right to freely express opinions.

2. The German Supreme Court’s opinion on promotional photographs exploiting highly sensitive social issues (Benetton-publicity).
